Canada: Notification on amendments to the Tents and Toys Regulations

On 22 January 2019, the Health Canada published a notice1 proposing to replace the existing flammability and labelling requirements under the Tents Regulations2 with specifications set out in a new National Standard of Canada entitled CAN/CGSB-182.1, Flammability and Labelling Requirements for Tents. The proposal also includes consequential amendments to the Toys Regulations3. The public consultation for the proposal is opened until 23 March 2019.

From the notice, the proposed Tents Regulations align the scope with the standard CAN/CGSB-182.14 which is under developing. The standard applies to consumer tents for outdoor use (including tents intended for both indoor and outdoor use), such as camping tents, backpacking tents, children’s tents, tent trailers, ice-fishing tents, dining shelters, beach shelters and screen houses. However, the tents intended for indoor use only would be excluded from the Tents Regulations.

Currently, children’s play tents are required to comply with both Tents and Toys Regulations. The Health Canada has proposed introducing the flammability requirements of indoor play tents into Toys Regulations. New measures like the addition of specific warning label and alignment on the definition of play tent with international standards are also under considerations. However, the other play tents that are being used at outdoor will remain subject to both Tents and Toys Regulations.

Meanwhile, the Health Canada is also seeking comments regarding the prohibition or restriction on the use of flame retardants in tents. Exposure to such chemicals may lead to adverse health effects.
