USA Oregon: Amendments of PQLs in chemicals of concern list 

december 2018- Relevant for: toys and children's products

On 7 December 2018, the State of Oregon approved an amendment1 of Practical Quantification Limits (PQLs) for the High Priority Chemicals of Concern for Children’s Health (HPCCCH) under the Oregon Toxic Kids Free Act. 

HPCCCH is a list of chemicals listed in OAR 333-016-2035 Exhibit A2 by the Oregon Health Authority, requiring manufacturers of children products to report products containing one or more HPCCCHs at or above PQLs for intentionally added chemicals or contaminants more than 100 ppm biennially. The next reporting due day will be on 1 January 2020. This is subject to children’s product sold or offered for sale between 1 January 2018 and 31 December 2019.

Starting from 1 January 2019, the following amendment of HPCCCH will be effective:

Five chemicals and their PQLs will be added: 

Three chemicals will be delisted:

1. Bisphenol S (BPS) (CAS no. 80-09-1)
2. Triphenyl phosphate (TPP) (CAS no.115-86-6)
3. Tris(1-chloro-2-propyl) phosphate (TCPP)
(CAS no. 13674-84-5)
4. Short-chain chlorinated paraffins (SCCPs) (CAS no. 85535-84-8)
5. 2-ethylhexyl-2,3,4,5-tetrabromobenzoate (TBB) (CAS no. 183658-27-7)

1. Phthalic anhydride (CAS no. 85-44-9)
2. Octamethylcyclotetrasiloxane (CAS no. 556-67-2)
3. Molybdenum and molybdenum compounds (CAS no. 7439-98-7)


The HPCCCH list containing 66 chemicals remains effective until 31 December 2018.

As the rulemaking process is ongoing, future updates of the Toxic Kids Free Act which requires manufacturers to remove chemicals from products or seek waiver will be announced later. The rule development and advisory committee meetings will begin in 2019.
