EU REACH: Restriction on CMRs in clothing, textiles and footwear published

On 12 October 2018, the European Union’s Official Journal (OJEU) published a regulation - Regulation (EU) 2018/15131, added a new restriction on hazardous substances (carcinogenic, mutagenic or toxic for reproduction (CMRs) category 1A or 1B) in clothing, other textiles and footwear under Annex XVII to REACH regulation as a newly added entry – Entry 72.

This new entry restricts groups of hazardous substances in clothing, other textile articles which come into contact with human skin, and footwear. These groups of restricted substances include heavy metals, phthalates, polycyclic aromatic hydrocarbons (PAHs), formaldehyde, certain azo dyes, and so on. Some of these restricted substances are overlapped with other REACH restrictions or other EU legislations. According to the new restriction, if there is any other stricter restriction or legislation on the chemical listed in this new restriction, the stricter one will apply.

The new restriction sets a general 24-months transitional period, and will apply from 1 November 2020.

•Medical devices within the scope of Regulation (EU) 2017/745;

•Disposable textiles (i.e. textiles that are designed to be used only once or for a limited time and are not intended for subsequent use for the same or similar purpose).
